Quoting the Driven Machinery Regulation
The DRIVEN MACHINERY REGULATION, 2011 in terms of section 43 of the Occupational Health and Safety Act, 1993, Section 11 and 12 states:
(11) The user shall ensure that every lifting machine as listed in the National Code of Practice is operated by an operator specifically trained for a particular type of lifting machine. The user shall not require or permit any person to operate such a lifting machine unless the operator is in possession of a certificate of training, issued by a person or organization approved for this purpose by the Chief Inspector, this includes the commissioning of the lifting machine.
(12) Offences and penalties: Any person who contravenes or fails to comply with the provision of regulation 18 shall be guilty of an offence and liable on conviction to a possible fine determined by the authorities, and/or imprisonment.

I own a business and my employees are operating without a Valid License, whom will be held responsible should an accident occur?
The business will be held liable and may be prosecuted depending on the circumstances of the incident or accident.
For how long is the license valid?
All Lifting Equipment Licenses are valid for 2 Years (24 Months).
May I drive my Forklift on a public road?
If you are going to use your forklift to travel on a public road, then the Forklift must be Roadworthy, just like a motor vehicle. The Forklift must be registered at the Licensing Department and have a Number Plate. The Driver/Operator of the Forklift must also have a Valid Forklift License and at least a valid C1 (Code 20) Driver’s License.
May I operate a Reach Truck when I have only a Forklift License?
No. And you may also not operate a Forklift when you have only a Reach Truck License.
May I operate an Electric Forklift with my License?
Yes. Our training and License enables you to legally operate a Diesel, Petrol, Electric, and Gas Forklift.
Must I only use a Forklift with solid rubber wheels?
No. The types of wheels of the Forklift are dependent on the terrain in which you operate. Ask your Forklift Dealer which type of wheels is recommended for your terrain.
Why should I spend the money to let my Forklift operators get a Valid License when they have been driving for years without a License?
Should an accident occur and you submit a claim or legal steps are taken, no insurance will cover you and/or there will be a bigger chance of losing the legal case. All costs in repairs/replacements will then be the responsibility of either the company or the driver or both.
